It can be prosecuted under either <strong>criminal<\/strong> or <strong>civil<\/strong> proceedings, depending on the nature of the offence.<\/p>\n\n\n\n<p><strong>Criminal fraud<\/strong> involves a breach of the <a href=\"https:\/\/trustpair.com\/gb\/blog\/the-fraud-act-2006-and-what-it-means-for-companies\/\"><strong>Fraud Act 2006<\/strong> <\/a>and is prosecuted by the Crown Prosecution Service (CPS) or the Serious Fraud Office (SFO). A claimant\u2014either an individual or a company\u2014may bring a case in the civil courts to recover losses caused by the fraud.<\/p>\n\n\n\n<p>In civil cases, the standard of proof is <strong>on the balance of probabilities<\/strong>\u2014the claimant must show it is more likely than not that the fraud occurred.<\/p>\n\n\n\n<p>Potential outcomes for civil fraud include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Restitution<\/strong> (return of misappropriated assets)<\/li>\n\n\n\n<li><strong>Damages or compensation<\/strong><\/li>\n\n\n\n<li><strong>Injunctions<\/strong> or other court orders<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The 4 elements of fraud<\/h3>\n\n\n\n<p>There are <strong>four legal elements of fraud:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Intentional misrepresentation of a material fact &#8211; a fact stated that is purposely false, and it is significant<\/li>\n\n\n\n<li>Knowledge of falsehood in representation &#8211; the offender must have known of the falsity<\/li>\n\n\n\n<li>Reliance on the facts and truth by the victim &#8211; the victim was supposed to rely on the truth or fact or did rely on it<\/li>\n\n\n\n<li>Damage as a result of misrepresentation and reliance &#8211; this could be financial damage or other damage<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><br>6 types of fraud<\/h2>\n\n\n\n<p>Let\u2019s take a look at some of the types of financial fraud. Financial fraud is a form of white-collar crime &#8211; a method of crime that is non-violent and financially motivated.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Internal fraud<\/h3>\n\n\n\n<p>This occurs <strong>when an employee misuses a business&#8217;s property or assets for their own gain or to cause losses to others.<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/trustpair.com\/gb\/blog\/the-fraud-triangle-understanding-fraud-risk\/\">The fraud triangle<\/a> can be applied to understand why people commit internal fraud. In this theory, the main three motivations are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pressure\/incentive: this could be a personal health issue, an urgent need for money, or pressure from an individual higher up in the business<\/li>\n\n\n\n<li>Opportunity: this happens when there&#8217;s a process gap or loose internal controls. It is also referred to as \u2018identity theft\u2019.<\/p>\n\n\n\n<p>Identity fraud can have several impacts on the victims:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Damage a business\u2019s reputation<\/li>\n\n\n\n<li>Financial losses<\/li>\n\n\n\n<li>Time lost spent changing details<\/li>\n\n\n\n<li>Damage credit status<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Vendor fraud<\/h3>\n\n\n\n<p>Vendor fraud refers to illegal and unprofessional payments that are made to real and false vendors or suppliers.<\/p>\n\n\n\n<p>Some <a href=\"https:\/\/trustpair.com\/gb\/blog\/watch-out-for-these-5-examples-of-vendor-fraud\/\">common types of vendor fraud<\/a> include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Suppliers being impersonated by fraudsters<\/strong> &#8211; the buyer gets told by the cybercriminal that payment details such as an account number have changed and offers new details ahead of a transaction. The fraudster may use an email address similar to the supplier&#8217;s actual email (for example @trostpair.com instead of @trustpair.com), this is called phishing.<\/li>\n\n\n\n<li><strong>Supplier email being hacked<\/strong> &#8211; fraudsters access the email address and send a hacked email to a supplier. Alternatively, they could be asking enough questions to get personal information from you to steal your identity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Health care fraud<\/h3>\n\n\n\n<p>Health care fraud in the UK remains a serious concern, affecting both individuals and the NHS. A notable case involved Dr. Rumi Chhapia, a GP in Portsmouth, who embezzled over <strong>\u00a31.13 million<\/strong> from local GP practices between August and September 2020 to fund an online gambling habit. <\/p>\n\n\n\n<p>As a consequence, he was sentenced to three years and four months in prison and ordered to repay \u00a3238,000 (<a href=\"https:\/\/cfa.nhs.uk\/about-nhscfa\/latest-news\/fraud-investigators-strive-to-recover-1-million-pounds?utm_source=chatgpt.com\">cfa.nhs.uk<\/a>). This type of internal fraud undermines public trust and diverts critical funds away from patient care. The NHS Counter Fraud Authority continues to strengthen its oversight and enforcement to combat such cases.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Payment fraud<\/h3>\n\n\n\n<p>Payment fraud occurs <strong>when a fraudster illegally creates or diverts payments<\/strong>. The amount can vary but can be significant, especially for serious offenses.<\/span><\/p><\/li>\n\n\n\n<li><p dir=\"auto\"><strong>Community Orders<\/strong>: <span style=\"color: initial;\">These can include requirements such as unpaid work, curfews, or rehabilitation activities. They are used to restrict the offender&#8217;s liberty and provide punishment within the community.<\/span><\/p><\/li>\n\n\n\n<li><p dir=\"auto\"><strong>Confiscation Orders<\/strong><span style=\"color: initial;\">&nbsp;are used to recover the financial benefit obtained through fraud.<\/span><\/p><\/li>\n\n\n\n<li><p dir=\"auto\"><strong>Additional Financial Penalties<\/strong><span style=\"color: initial;\">&nbsp;such as compensation orders to victims and payment of prosecution costs.<\/span><\/p><\/li>\n<\/ol>\n\n\n\n<p><span style=\"font-size: revert; color: initial;\">Prison sentences can be avoided and compensation and fines can be enforced depending on the severity of the case. <\/span>For example : in the UK, a rogue trader exploited a member of the public who used her life savings to pay for roofing work services that weren&#8217;t needed.<\/p>\n\n\n\n<p>The criminal had to pay financial penalties including \u00a327,500 in compensation, a fine of \u00a36,500, \u00a34,250 towards prosecution costs, and a \u00a3190 victim surcharge.<\/p>\n\n\n\n<p><strong>Recap<\/strong><\/p>\n\n\n\n<p>There are many different types of fraud in law.
